Will We Resist a Massive Government/Corporate Conspiracy?

What will we do about the PRISM conspiracy?

With due respect to the Turkish protesters — with whom I agree — PRISM is a trillion times worse than Taksim Square.

PRISM is run by the NSA and FBI.

The charter of the National Security Agency, a spy agency created to collect foreign intelligence, specifically states that it is prohibited from “acquiring information concerning the domestic activities of United States persons.” Simple English. NSA isn’t even allowed to spy on Americans accidentally.

The Federal Bureau of Investigation’s self-professed mission is to “protect and defend the United States against terrorist and foreign intelligence threats, to uphold and enforce the criminal laws of the United States, and to provide leadership and criminal justice services to federal, state, municipal, and international agencies and partners.”

The NSA claims that its actions are “consistent with U.S. laws and the protection of privacy and civil liberties.”

Yet:

Not.

The darkest dystopian visions of the future — 1984, Brazil, Sleep Dealer — have come to chilling, horrific life. There can no longer be any illusion that the U.S. is a democratic republic. Everything we learned as schoolchildren was a lie. The U.S. government does not serve us. This is not a government by the people or for the people. The regime in Washington no more respects our rights as citizens, our dignity as individuals, than the North Korean dictators of Pyongyang. We eat better and watch better TV but where it counts, at essence, we are exactly the same.

The Washington Post and the British newspaper The Guardian have broken a startling blockbuster, perhaps the biggest story of our lives. “The NSA and the FBI,” writes the Post, “are tapping directly into the central servers of nine leading U.S. Internet companies, extracting audio and video chats, photographs, e-mails, documents, and connection logs that enable analysts to track one target or trace a whole network of associates.”

This is a government-big business conspiracy of the first order, so breathtaking in scope and ambition that it is scarcely comprehensible.

According to a classified PowerPoint presentation leaked by a patriotic intelligence officer said to be consumed with “horror at the capabilities” of the PRISM system, the U.S. government taps directly into the servers of Microsoft, Yahoo, Google, Facebook, PalTalk, AOL, Skype, YouTube and Apple. Google, the biggest Internet company on earth, controlling 16% of global Internet traffic, pretended to stand up to China’s clumsy attempts to censor the Web, but when the NSA came calling, they saluted, bent over and paid for lube.

Google could have litigated. They could have called a press conference. They could have leaked the threats. Instead, they turned over everything. Voluntarily. If you’re online, Google has given your “private” information to the feds. “Don’t be evil?” Ha.

If capitalism counts for anything, contracts have to be enforced. There is a universally understood implicit contract between Internet users and companies like Microsoft and Apple: they keep your data private to the best of their abilities. They might get hacked; a court may serve them with a subpoena. Stuff happens. But they’re not supposed to voluntarily give every bit and byte to the government just because they asked nicely. Because they want to be considered, in government parlance, “a trusted company.”

The government trusts them. But now, can anyone else?

These Internet giants had a choice. They could have told the government to take a walk. According to the Post: “Apple demonstrated that resistance is possible when it held out for more than five years, for reasons unknown, after Microsoft became PRISM’s first corporate partner in May 2007. Twitter, which has cultivated a reputation for aggressive defense of its users’ privacy, is still conspicuous by its absence from the list of ‘private sector partners.'”

PRISM exposes the horrifying, galling partnership between the biggest Silicon Valley corporations and an out-of-control security state. No one is safe in a society governed by such powerful elites colluding so closely.

It also belies previous official claims that anti-terrorism and other security-based intelligence-gathering operations are specifically targeted at likely threats. To the contrary, the U.S. government is plainly interested in — and has largely succeeded at — intercepting, collecting and analyzing every electronic communication in the United States, and presumably abroad as well.

For example:

“According to a separate ‘User’s Guide for PRISM Skype Collection,’ that service can be monitored for audio when one end of the call is a conventional telephone and for any combination of ‘audio, video, chat, and file transfers’ when Skype users connect by computer alone. Google’s offerings include Gmail, voice and video chat, Google Drive files, photo libraries, and live surveillance of search terms.”

Offerings.

That’s what they’re calling the emails we send each other. The photos we store in the “cloud.” Our video chats.

Everything we do online. Our entire online lives.

Offerings. They’re offering us up.

Yeah, of course, we knew they — the government — not our government, mind you — They — the others — the minions of the 1% — were spying on Americans at an epic scale that the Stasi spymasters depicted in the East German drama “The Lives of Others” couldn’t have dreamed of.

First came the 2001 USA-Patriot Act, which opened the door to officially-sanctioned law breaking in the supposed service of national security. In 2002 there was DARPA’s Total Information Awareness, the Bush Administration’s post-9/11 data mining operation, an attempt to “turn everything in cyberspace about everybody—tax records, driver’s-license applications, travel records, bank records, raw F.B.I. files, telephone records, credit-card records, shopping-mall security-camera videotapes, medical records, every e-mail anybody ever sent—into a single, humongous, multi-googolplexibyte database that electronic robots will mine for patterns of information suggestive of terrorist activity.” After an uproar, Congress defunded TIA — so its staff and activities simply packed up and moved to the NSA, where they continue to work today.

There was also AT&T’s secret room 641A, the site of “clandestine collaboration between one big telecommunications company, AT&T, and the National Security Agency to facilitate the most comprehensive illegal domestic spying program in history.” That story broke in 2007.

A few days ago, another sweeping violation of privacy came to light. This time, “the government has obtained phone numbers of both parties on every Verizon call, the call’s duration, location data and the time of day the calls were made.” That program is ongoing. (Were other telecommunications carriers involved? Probably. This is one of the few rubber-stamp FISA court warrants to come to light.)

It doesn’t take a genius to extrapolate from these stories to the massive scope of PRISM. But there’s a big difference between knowing the government is reading your emails and looking at your dirty pictures, and KNOWING they’re doing it. Now we KNOW.

So. What are we going to do about this?

Dropbox, Facebook, Google, Yahoo, Microsoft and Apple have all denied participation in PRISM. Maybe it’s all just a bad dream!

Probably not, though.

First: we need a full, independent investigation. Not by Congress. By someone we can trust. It’s hard to imagine who. Certainly not one of the big tech companies accused of betraying us.

Second: if this story turns out to be true, President Obama, Vice President Biden and the entire cabinet must resign and face prosecution. According to the Post, data collected from the rogue PRISM program is relied upon for roughly one out of seven of the President’s Daily Briefs on intelligence matters. “That is a remarkable figure in an agency that measures annual intake in the trillions of communications,” notes the newspaper. It means that knowledge of PRISM, and authorization thereof, goes to the Oval Office. There must be accountability. Swift accountability.

Members of Congress, corporate executives of the Internet companies involved, and of any other companies, must be held to account as well. Prosecutions should come quickly.

Finally, we have some hard questions to ask ourselves.

I’d start with this one:

What does it mean to be an American? Are we citizens, free men and women? Or are we serfs, not vested in even the primal right to talk to our friends and family members without some goddamn government asshole listening in?

Unemployment is High. Why Are We Importing Foreign Workers?

Unemployment is sky-high. Sustained long-term unemployment is at record levels. So why the hell are we importing foreign workers?

The immigration reform bill moving through Congress will throw open the door to millions of new foreigners — people who aren’t here yet — to enter the United States to work. And we’re not talking about crappy fruit-picking gigs Americans supposedly don’t want (more on that below).

“American” (you have to wonder about their loyalties) lawmakers want foreigner nationals to fill America’s high-paying tech jobs. While Americans are out of work.

At the risk of sounding like Pat Buchanan: WTF?

For at least 20 years, the U.S. economy has been replacing good manufacturing jobs with bad service jobs. Salaries have fallen. Which has depressed demand. As things stand, there’s one bright spot: the potential for the IT sector to lift us out of the rut. To paraphrase George Orwell’s “1984”: If there is hope for America’s unemployed, it lies with tech.

Make that: “lied.” Because America’s tech companies — which makes most of its money selling its crap to Americans — are hell-bent on hiring just about anyone who is not an American citizen.

Economists say jobs aren’t a zero-sum game. But unemployment would certainly be lower if employers were forced to hire Americans who were qualified, or train them. But they’re not. So they don’t. Companies “want people to hit the ground running,” Wharton management professor Peter Cappelli, author of Why Good People Can’t Get Jobs, told USA Today. “They don’t want to train anybody.”

Bosses say they just want to fill positions. But that’s just not true.

What bosses want is flexible — i.e. compliant, uncomplaining — indentured labor. Foreign workers fit the bill perfectly. If foreigners get fired, they lose their visas and have to go back home. How likely are they to ask for a raise, much less gripe about long hours or unpaid overtime, with the boss’ sword raised over their heads?

And so, even as born-in-the-USA Americans — many of them experienced programmers with fancy “STEM” degrees from the nation’s top engineering schools — languish without jobs, sinking into poverty and getting evicted from their homes, Big Tech is passing them over in favor of indentured workers from India and other foreign countries.

“As drafted,” reports FoxNews, the bill would raise the current cap on so-called H-1B visas for highly skilled workers… The legislation also included new protections designed to ensure American workers get the first shot at jobs, and high-tech firms objected to some of those constraints.”

Re-read that last phrase.

“High-tech firms objected” to “new protections designed to ensure American workers get the first shot at jobs.” Thanks to the Gap-shirt-wearing “revolutionary” “pioneer” billionaires of Silicon Valley, those common-sense protections — which didn’t say you can’t hire foreign workers, only that you have to search for Americans before you do — have been cut out of the bill. Nevertheless the number of indentured foreign workers likely to be authorized by the new law has shot up to at least 300,000 annually.

That means millions of new foreign workers taking our best new jobs.

Which firms are spending big bucks to screw unemployed American tech workers? Unbeknown to most Internet users, Mark Zuckerberg’s Facebook is the tip of the spear of an anti-American worker, D.C. multi-million-dollar lobbying juggernaut. Facebook and their insanely rich right-wing corporate allies claim they need foreigners because they can’t find enough qualified U.S. citizens. “Microsoft has 3,500 high-tech jobs that they cannot fill. Intel has 1,700. I mean, you can go on and on,” Dan Turrentine of the trade group TechNet told NPR. Good thing it was radio; smirks look awful on TV.

The tech giants are lying. There are plenty of unemployed IT workers right here in the USA.

Officially, tech sector unemployment is a relatively low 3.7%. Of course, there’s still that question: why hire any foreigners as long as there’s one single American who needs a job?

Anyway, that number is deceiving. According to a recent study by the Economic Policy Institute, colleges and universities graduate 50% more students with degrees in computer and information science and engineering than get hired into those fields each year. Most of these bright young grads are forced into other professions, or simply remain unemployed. “The supply of high-tech workers,” concludes  EPI vice president Ross Eisenbrey, is “a problem we don’t have.”

Millions of tech-savvy Americans are out there looking for jobs. Yet big tech doesn’t want them.

“If anything, we have too many high-tech workers: more than 9 million people have degrees in a science, technology, engineering or math field, but only about 3 million have a job in one,” Eisenbrey wrote in The New York Times. “That’s largely because pay levels don’t reward their skills. Salaries in computer- and math-related fields for workers with a college degree rose only 4.5% between 2000 and 2011. If these skills are so valuable and in such short supply, salaries should at least keep pace with the tech companies’ profits, which have exploded.”

On average, the typical unemployed U.S. tech worker is better trained than the foreign workers who are taking their jobs.

We’re also seeing this import-foreigners-to-hell-with-Americans phenomenon on the low end of the employment ladder.

Like Zuckerberg, large-scale farms claim they can’t find Americans willing to work for them. In their case, it’s hard, low-paying field work: picking fruits and vegetables.

Once again, it turns out that there are lots of Americans willing to do the job — but the big farms pass them by. Agribusiness prefers compliant slave labor. “When Jose gets on the bus to come here from Mexico he is committed to the work,” Jon Schwalls, director of operations at Southern Valley farm in Georgia, said. “It’s like going into the military. He leaves his family at home. The work is hard, but he’s ready. A domestic [American citizen] wants to know: What’s the pay? What are the conditions?” Such gall.

Southern Valley is one of numerous farm operations being sued by “Americans, mostly black, who live near the farms and say they want the field work but cannot get it because it is going to Mexicans. They contend that they are illegally discouraged from applying for work and treated shabbily by farmers who prefer the foreigners for their malleability,” reports The Times.

We know Americans are willing to do field work because, until the 1970s, two-thirds of farm workers were U.S. citizens and a third were foreigners. Now it’s the other way around. Many are undocumented. Farms were recently forced to concede that their legally required efforts to recruit Americans for field work “had not been made or had been intentionally not serious.” Nevertheless, even as Americans who want these jobs get rejected (because they ask about pay and conditions), the U.S. continues to issue 85,000 H-2A visas to foreign field workers.

No wonder the immigration bill has bipartisan support. Both the Democrats and the Republicans work for their big corporate donors, not for us. Business wants salaries low, labor weak. There’s only one reason to import foreign labor: to depress wages.

If the supporters of import-more-foreigners immigration reform weren’t trying out to screw over American workers, they’d grant permanent resident status (“green cards”) to foreign workers so that they could stay legally, join unions, and negotiate on an equal footing with employers. But that would defeat the purpose.

Why Sheryl Sandberg is Evil

Sheryl Sandberg is the author of a new book that you’ve heard of if you’re connected enough to be reading this, promoted by one of those PR tsunamis that publishers inflict upon the public every year or two in hopes of recouping six- or seven-figure advances: Lean In: Women, Work and the Will to Lead.

     She is also the chief operating officer of Facebook.

“Lean In,” we are told, is More Than Just a Book. It is a social movement. A way of life.

A happening.

“She is someone who works at Facebook,” moons Garance Franke-Ruta in The Atlantic. “Who leads Facebook. Who helped invent the Facebook we know today. Hers is a Facebook feminism.”

Yuck.

Comparing herself to Betty “The Feminine Mystique” Friedan, Sandberg wants her book to inspire “Lean In Circles” where women would meet to plot how to climb the corporate ladder and achieve gender parity in the boardroom. At their creepy gatherings, women will learn how to act more boldly, aggressively – more like men. Her idea of how men act, anyway.

Franke-Ruta again: “Sandberg is an unapologetic capitalist and senior manager who began her career in Washington, DC. She says she’s interested in seeing more women in leadership posts in corporate America and in the highest ranks of government. That means more women at the top, more women in positions of power, and more women who have the training and experience to lead within institutions actually getting a shot at doing – or daring to do – it.”

Visions of armies of women in beige blouses and dark safe corporate jackets marching through the streets of suburban office parks, chanting quotes from and waving copies of Sandberg’s manifesto, fill her dreams.

I think Sandberg is one of the most insufferable fools in the world of business. Which is saying something. But I don’t hate her for the same reasons as people like Maureen Dowd.

In the New York Times, columnist Dowd sums up Sandberg as a “PowerPoint Pied Piper in Prada ankle boots.” Such Dowdian snark, though cruel, is fair. Sandberg, after all, uttered a comment whose revealing immodesty would make Donald Trump blush: “I always thought I would run a social movement.”

Memo to SS: You don’t “run” a social movement. Lead it, maybe. If you’re lucky.

The Paper of Record asks the six- or seven-figure question:

“Even her advisers acknowledge the awkwardness of a woman with double Harvard degrees, dual stock riches (from Facebook and Google, where she also worked), a 9,000-square-foot house and a small army of household help urging less fortunate women to look inward and work harder. Will more earthbound women, struggling with cash flow and child care, embrace the advice of a Silicon Valley executive whose book acknowledgments include thanks to her wealth adviser and Oprah Winfrey?”

Oh, and her husband quit his job to mind the homestead. That’s convenient.

Still, Dowd et al’s argument that Sandberg’s wealth denies her the standing to issue advice to working women leaves me cold. It doesn’t matter who or what she is; either her ideas are smart and/or good for society or they’re not. A doctor who tells you to diet and exercise is giving you good advice even if she’s fat and smokes. Hell, I’m a dude yet I think I know better than Sandberg what’s better for women. For all I know, and many women agree, she gives good advice to ambitious women trying to climb the corporate ladder.

What grates about Sandberg, I think, is less the fact that a person born at mile 25 thinks she won the marathon because she worked so hard, than her failed attempt to elevate a self-help book to the level of politics.

Sandberg doesn’t know about politics. She doesn’t even know about identity politics.

Politics – debate and discussion about how we should live our lives and how to solve our problems after we have identified them – is hard. Very few people – including most politicians and elected officials – undertake the lifetime of thinking and research, or possess the magic of inspiration, it takes to come up with a transformative vision for an alternative future. The U.S. is tragically devoid of brilliant public intellectuals – our best and brightest political minds are ruthlessly censored and marginalized.

That’s real politics.

Then there’s identity politics.

Identity politics, the struggle by women, gays, ethnic minorities and so on against their privileged rivals in the economy and society, is a dead end. It’s tokenism. At best, movements based on identity politics grant special privileges to a tiny subset of traditionally oppressed demographic groups. Meanwhile, the overall hierarchical class structure remains intact.

It was moving, for example, to watch African-Americans celebrate the election of Barack Obama. Four and a half years later, however, not only can we see that the status of blacks remains the same as 2008 – harassed, arrested, shot and imprisoned at disproportionately high rates, discriminated against in the workplace, deprived of access to a high-quality education, their lifespans shortened by disease and poverty – Obama himself, supposed symbol of progress, doesn’t even talk about racial problems, much less try to fix them.

Everyone’s goal ought to be to liberate humanity from oppression. Identity politics distract from this struggle. They liberate no one.

What Sandberg advocates is even less worthwhile than identity politics.

Sandberg wants rat-race politics. Men, she argues, act like a bunch of testosterone-fueled jerks at work. She wants women to beat them at their own game.

“When a man is successful, he is liked by both men and women,” writes Sandberg. “When a woman is successful, people of both genders like her less…The solution is making sure everyone is aware of the penalty women pay for success. Recently at Facebook, a manager received feedback that a woman who reported to him was ‘too aggressive.’ Before including this in her review, he decided to dig deeper. He went back to the people who gave the feedback and asked what aggressive actions she had taken. After they answered, he asked point-blank, ‘If a man had done those same things, would you have considered him too aggressive?’ They each said no. By showing both men and women how female colleagues are held to different standards, we can start changing attitudes today.”

Man, I sure wouldn’t want to work at Facebook. It’s a lot more fun to work in an organization where no one – men or women – comes on too strong. Where people work as a team.

“Lean In” fails because Sandberg wants to accelerate the “race to the bottom” behavior that has become standard in American business and politics. She is not the solution to a problem.

She is a problem.

What we need to do is create a society in which everyone – men and women, gays and straights, whites and blacks, and so on – enjoys equal access to the good things in life. Whether like me you have concluded that capitalism, the idea that we are all created unequal, is evil and irredeemable, or you’d prefer to reform the system to make it more humane, replacing male assholes with female assholes gets us nowhere.

Rather than tell American women (or men) what to do, Sandberg would do better to consider her own role in making the United States a worse place to live.

She’s worse than a garden-variety “an unapologetic capitalist.” The virtual antithesis of Google’s “don’t be evil,” the company where she works has become one of the most culturally and economically destructive businesses in America by monetizing the death of a nation’s right to privacy. (This is worth, by one calculation, about $130 per user.) Facebook is so unaccountable that it doesn’t even provide a phone number for customer service. Now it’s emulating the reprehensible Arianna Huffington, attempting to accelerate the aggregation of what’s left of journalism outlets so essential to the health of civic life and democracy with its latest redesign of its News Feed.

Facebook is the face of the New Economy. It sucks $5 billion a year out of the U.S. economy, yet it puts almost nothing back in. It employs fewer than 4,000 Americans. (By way of comparison, GM—which generates less than twice as much as Facebook—employs more than 200,000 workers.)

Even if Sandberg is successful with her Lean In Circles, she will have accomplished the same thing as Facebook. She will have made a tiny privileged of elites richer—and 99% of America poorer.

You know society is about to collapse when 140 characters is simply too much.

Congress Should Mandate Minimum Number of Phone Reps

I don’t know if Mark Zuckerberg suffers from agoraphobia, but his company seems to have missed the jet age.

If you’re like me, you travel a lot. And if you’re on Facebook, odds are that you’ve been locked out of your account—even though you entered the correct password—because you logged in from an “unfamiliar location.”

Facebook’s test to make you prove you are who you say you are is bizarre: they show you randomly selected pictures of your Facebook “friends” and ask you to identify them. But most of my “friends” are readers and fans of my cartoons and books. I don’t know their faces. Moreover, not all of my “friends'” photos are of themselves. One Facebook test—I kept failing—presented me with pictures of potted plants.

It’s an idiotic test, one that trips up a lot of people. David Segal, who writes The Haggler consumer advocacy column for The New York Times, quotes Bryan Dale of Toronto: “Given that I use Facebook for networking and had never met most of my ‘friends,’ [Facebook’s ID test] was difficult. It was made impossible, however, because most of my Facebook friends are connected with pit bull advocacy and many of their pictures presented to me were actually pictures of their dogs.”

Why does Facebook freak out when I log in from San Diego while Citibank allows me to move thousands of dollars using no more than a password—from Taliban-controlled Afghanistan?

During my third week of Facebook Lockout Month I tried to call the company to ask that question and plead my case.

I couldn’t.

Facebook doesn’t have a customer service telephone number.

This, incredibly, is normal in the technology sector. A transnational corporation valued at tens of billions of dollars, with hundreds of millions of customers, has no way to get in touch with them in a hurry. Even if you’re a would-be zillionaire investor, you can’t call. You have to know someone inside.

What if someone is posting pornographic photos of your child via Twitter? What if someone has hacked into your account? What if you’re in San Diego and can’t figure out which of your Facebook “friends” owns that white pit bull with the black spot?

Some tech companies have phone numbers, but there’s no way to talk to a live human being. “Twitter’s system hangs up after providing Web or e-mail addresses three times,” Amy O’Leary reports in The Times. “At the end of a long phone tree, Facebook’s system explains it is, in fact, ‘an Internet-based company.’ Try e-mail, it suggests.”

Tried it. Repeatedly. Never heard back.

This is standard practice with tech companies. I’ve left customer service request messages for Apple, Adobe, Google and countless other firms over the years. I heard back maybe one time out of ten.

“LinkedIn’s mail lists an alternate customer service number. Dial it, and the caller is trapped in a telephonic version of the movie ‘Groundhog Day,’ forced to work through the original phone tree again and again until the lesson is clear: stop calling,” writes O’Leary.

It was easier to get in touch with Osama bin Laden. Still is, probably.

This screw-the-customers crap began in the 1970s, when America began falling apart. First they made us pump our own gas. Then they made us bag our own groceries. The Better Business Bureau stopped accepting complaints. Finally, corporations started charging us for services—the phone company’s automated 411 information, automatic teller machines, electronic airline tickets—that, even before fees, had saved them money, increased their profits, and put thousands of workers out of work.

Still, when tech companies worth $10 billion don’t have a working phone number, you know they’ve taken “drop dead” to a whole new level.

“A lot of these companies don’t have enough employees to talk to,” Paul Saffo, a technology forecaster in Silicon Valley, told The Times. “Facebook, for example, has just one employee for every 300,000 users. Its online systems process more than two million customer requests a day.”

Indeed, one of the more troubling aspects of the Internet revolution is that the new tech sector employs far fewer workers per dollar of capitalization than the older industries, such as manufacturing, that it is replacing. Big banks like Goldman Sachs may be profit-sucking vampire squids bleeding American dry, yet they’re not nearly as destructive as high-valuation, low-payroll leeches like Twitter and Facebook.

General Motors, a company with $39 billion in equity value, directly employs 207,000 people, plus many more indirectly through its suppliers. Facebook has nearly twice the market capitalization ($67 billion) but employs a miserly 1,400 workers. On Wall Street, Facebook is worth more than GM. On Main Street, GM is worth 250 Facebooks.

It should be obvious to everyone that companies have a moral obligation to be responsive to the public, and that their duty to provide high-quality customer service increases exponentially as they grow in size. It should be equally obvious that companies that extract billions of dollars in profits from the American public have a moral responsibility to hire members of the American public. We’re not talking “make work”—but the minimum number of employees needed to conduct business in a responsible, professional manner.

Clearly the big tech companies are refusing to meet these minimum standards.

We should demand, Congress should pass, and the President should sign a law that sets clear standards for customer service by large corporations. For every x number of customers and/or every y million dollars of capitalization, there should be one U.S.-based, native English-speaking, professional customer service rep waiting to take our calls and help us.

Right away.

No phone tree.

No waiting.

It isn’t free speech, or habeas corpus, yet surely the Founding Fathers would agree: hard-working Americans have the right not to be driven crazy because boy billionaires are too cheap to hire some help.
