When I was 14, this man kidnapped a 14-year-old girl walking to school three miles from my house, raped and killed her. She was not his only victim. Now, due to a DA screwup, he is back in town and may soon be released. This is such a creepy flashback, like something out of a Stephen King story. I never imagined I’d be so upset by something like this, especially since I didn’t know the victim, but it’s like I’m right back there.

*His conviction was overturned in 2001 by the U.S. Sixth Circuit Court of Appeals, which ruled that Gall didn’t get a fair trial because it did not address the issue that Gall didn’t have the chance to show he may have had an “extreme emotional disturbance” before the murder.*

As the “Church Lady” used to say: “Well, isn’t that special????”
It’s pretty appalling that the prosecutors screwed up this badly. Obviously everyone will be ill served, including the suspect himself, if he walks free. I wouldn’t give him much chance of living very long on the outside. Daytonians remember what he did very clearly.
Then there is the case of the DuPont heir raping his toddler daughter repeatedly. The prosecution did their job and won a conviction. The judge gave him probation. I really hope that both of these perverts get justice.

This report, from December 2008, exemplifies why the prosecution MUST adhere to legal standards. Malfeasance on their part resulted in “expunging” the record – as if it never happened.
